Provisions and directives

Note  
The laws and regulations listed below are valid in Germany.  
Other or additional laws and regulations may apply in other  
countries.  
The effects concerning the changing climate can be seen  
world-wide. Protection of the climate is therefore one of the  
mosimportanroles of the human race. This role is a huge  
challenge for all concerned.  
The so called Kyoto Protocol defines, among other things,  
world-wide tars to protecthe climate. Aside from reduction  
tars for carbon dioxide, this protocol defines reduction tar‐  
s for fluoride containing greenhouse gases e.g. for refrig‐  
eranR134a owing to the high greenhouse potential.  
The cut-off date for bringing vehicles thawere type approved  
before 2011 into operation for the firstime with R134a refrig‐  
eranis 31.12.2016 (this applies to countries within the EU,  
differenregulations may apply in countries outside the EU).  
From 01.01.2017, vehicles musnobe newly commissioned  
in countries of the EU unless their refrigerancircuiis charged  
with refrigeranwith a global warming potential less than 150.  
R1234yf refrigeranmeets the requirements of Regulation  
(EC) No. 706/2007.  
Within Europe, for example, a large number of relevanstatutes  
have been introduced for the motor industry. In Germany, for ex‐  
ample, the climate protective regulation concerning chemicals  
came into force from the 1sof Augus2008 in addition to Euro‐  
pean legislation.  
In the European Community, various regulations directives for  
handling refrigeranhave been introduced e.g.:  
♦ Regulation (EC) No. 1005/2009  
♦ Regulation (EC) No. 2037/2000  
♦ Regulation EU No. 517/2014  
♦ Regulation (EC) No. 706/2007  
♦ Regulation (EC) No. 307/2008  
♦ Directive 2006/40/EC  
In Germany, additional regulations concerning refrigeranhave  
been introduced e.g.:  
♦ Climate Protection Regulation Concerning Chemicals (Chem‐  
ikalien-Klimaschutzverordnung), Closed Substance Cycle  
Waste ManagemenLaw (Kreislaufwirtschaftsgesetz, KrWG),  
♦ Technical Regulations for Compressed Gases (Technische  
Regeln Druckgase, TRG).

Note  
The R1234yf refrigeranis currently noreferenced in the various  
rules and regulations. Due to its chemical composition, however,  
ican be assumed thaiwill be included the nextime the relevan 
rules and regulations are revised. The rules and regulations per‐

adhered to when handling the R1234yf refrigerant.  
Maintenance and repairs to refrigerancircuits for air conditioning  
systems  
Only persons who are deemed to be competenin accordance  
with Regulation (EC) No. 307/2008 may carry ourepairs and  
service work on the refrigerancircuiof an air conditioning system  
(applies to countries in which this regulation is valid - differen 
rules and regulations may apply in other countries).  
In general the following applies:  
Operation, maintenance, decommissioning, duty to accepre‐  
turned material  
♦ It is prohibited to allow the release into the atmosphere of ma‐  
terials contained in products containing refrigerants during the  
operation, maintenance or removal from service of such prod‐  
ucts.  
♦ Records musbe kepabouthe quantity used during opera‐  
tion and repair work so that, if necessary, a schedule of  
application can be presented to the relevanauthorities on re‐  
quest. A record sheeneed no longer be kepwithin the EU  
due to respective European parliamenlegislation from 2005.  
Other legislation may apply in countries nobelonging to the  
EU.  
♦ Companies thasell materials and preparations listed in the  
above mentioned legislation have a duty to accepreturned  
materials and preparations after they have been used, or to  
ensure thaa specified third party will accepthem.  
♦ Maintenance work and decommissioning of products thacon‐  
tain refrigeranreferred to in the above mentioned legislation.  
The returned substances and preparations referred to in this  
legislation may also only be accepted by persons who have  
the necessary specialisknowledge and technical equipment.  
Closed Substance Cycle Waste ManagemenLaw (Kreislaufwirt‐  
schaftsgesetz, KrWG) as well as processing and disposing of  
contaminated refrigeranand refrigeranoil  
The respective rules and regulations of the country musbe ob‐  
served here.  
2.2  
Charging refrigerancircuiwith differen 
refrigerants  
Air conditioning systems developed and designed for R1234yf  
refrigerancannosimply be charged with a differenrefrigerant,  
e.g. R134a.  
Note  
According to currenlegislation, R134a refrigeranmusnobe  
charged in vehicles thawere type approved for R1234yf refrig‐  
erant.
